Dear Valued Customer:
I write you with important developments concerning the Environmental Protection Agency regulation of
antimicrobials in the USA.
November 2009, the EPA held the FIFRA Scientific Advisory Panel Meeting concerning the
“Evaluation of Hazard and Exposure with Nanosilver and Other Nanometal Pesticide Products”. The
FIFRA SAP provides advice, information and recommendations to the Agency Administrator on pesticide
issues regarding the impact of regulatory actions on health and the environment. The panel serves as the
scientific peer review mechanism of the EPA, and is structured to provide balanced expert assessment of
pesticides. Antimicrobials are considered pesticides by EPA.
The findings and recommendations of the SAP concerning Nanosilver were released late January. Please

The findings call into question the current level of understanding and testing available to EPA on
Nanosilver’s human and environmental impact. Quotes’ from the report are:
• “Nanoscale particles including Nanosilver have been shown to be capable of penetrating
biological barriers such as cell membranes... and can enter into cells themselves.”
• “...the Panel believed that the rate of silver ion production, as well as the distribution of silver in
tissue, may differ substantially between silver nanomaterials and other forms of silver.”
• “Nanosilver can also potentially act as carriers of other toxic chemicals.”
• “Environmental fate of silver nanomaterials remains unclear…”
• “The Panel believed that the lack of existing data suggests that it would be necessary to conduct
research on a case by case basis…”
• “There have been very few studies that directly assess human exposures to Nanosilver
particles…”
As a leader in the antimicrobial industry, Noble Biomaterials asks you to educate yourself on these
issues. As the number of antimicrobial solutions has grown, the EPA has become more involved in the
enforcement of regulations as shown by the recent $1,000,000 fine levied against a sports wear brand.
Be aware the EPA has stated that “EPA has recently learned at least one registered pesticide product
allegedly contains Nanosilver even though that information was not provided in the product’s
application. EPA has not knowingly approved a pesticide product to date” (Memo dated 10/6/2009,
